Bernhoft Law Firm Uses Inference to Quickly Identify Evidence of Government Misconduct in U.S. v. Struckman Case
Judge orders exclusion of evidence and witness based on pre-trial defense motions in high-profile tax-evasion case
Lynbrook, NY (October 22, 2007) – Defense attorneys in the federal criminal case, United States v. Struckman, gained a significant victory as a result of evidence identified using Inference Data's electronic discovery platform. With Inference's dynamic searching and review capabilities, Bernhoft Law Firm attorneys were able to prioritize and review a large data collection and rapidly find documents that were most relevant to their defense, strengthening their leverage in pre-trial discussions and strategy. Those documents included e-mails and memoranda containing evidence of discovery violations and quid-pro-quo deals with government witnesses. Based on this evidence, The Honorable Robert M. Takasugi, U.S. District Court Senior Judge, Central District of California, Los Angeles Division, issued an order on October 16 excluding evidence attributed to an anonymous government informant and barring one of the government's key witnesses from testifying at trial. The trial is scheduled to begin October 29, 2007 in Seattle, WA.
The first phase of discovery in the high-profile case accusing David Struckman of tax evasion included more than 300,000 government documents. According to Robert G. Bernhoft, president, Bernhoft Law Firm, S.C., Inference's e-discovery platform enabled Bernhoft attorneys to identify, analyze and compare all the documents in their electronic form in less than 90 days.
"Without Inference, it would have taken over a year to go through what the government heaped on us, and we would never have been able to meet the motion filing deadlines to raise the issues that resulted in the judge upholding our assertion of government misconduct," said Bernhoft. "The key for us was efficiency, and Inference enabled us to sort through and review hundreds of thousands of documents quickly, identifying the critical evidence that led to Judge Takasugi's order."
Lou Andreozzi, CEO of Inference Data, commented, "Bernhoft is a top boutique litigation firm clearly focused on providing its clients with the most effective means of defense. The firm chose Inference to drive its review process because it is a strong proponent of using leading technology to review evidence and advocate for its clients. As a result, Inference played a critical role in securing this victory."
